A string of recent cases have cast doubt on the legality of policies that have been in personnel manuals, employee handbooks and similar documents for years. In some instances, the mere existence of these policies may violate the law. In other situations, adherence to the policies will lead to unlawful conduct. In other situations, the policies now have limited legal effect. No employer should assume that they are immune from these developments.
