Insuring Employment Disputes

Sherman & Howard's Employment Practices Litigation Insurance (EPLI) attorneys review prospective EPLI policies offered to employers to determine if the employers should buy the insurance coverage, consult with them on the significance of particular provisions in the policy agreements, and defend employers with EPLI policies. EPLI is intended to provide some coverage for the cost of attorneys and legal expenses if a case is brought by an employee or former employee, and to cover some damages awarded in such a case. Many who purchase these policies are surprised by the deductible that must be reached before the insurance coverage applies to the situation, the limits on the types of liabilities covered, and the vast amounts of control that insurance companies wield over cases. If a claim is made under an EPLI policy and coverage is denied by the insurance company, we represent employers in obtaining the insurance to which they are entitled under their insurance contracts.
