Sherman & Howard's real estate attorneys represent both developers and local governments in economic development, land use and entitlement matters, including annexation; urban renewal plans; infrastructure agreements and subdivision improvements agreements between developers and local governmental authorities; revenue sharing agreements to provide economic incentives for large commercial developments; zoning; the construction and dedication of public improvements; site plan/planned building group approvals; affordable housing covenants and planning; and fire code and building code issues. Working in conjunction with Sherman & Howard's public finance group, we draft and negotiate redevelopment agreements with developers and special districts and have helped to develop difficult urban renewal areas by combining financing tools such as tax increment, public improvement fees and a metropolitan district mill levy to achieve the desired objectives. We also have extensive experience in the many aspects of redeveloping former military bases. In addition, we negotiate agreements among adjacent developers for the joint-development of vertically- and horizontally-integrated mixed-use projects; prepare conservation easements with respect to ranches and historically designated structures and work closely with tax counsel and other advisors with respect to realization of related tax deductions and credits; assist in connection with the remodeling and conversion of apartment projects to for-sale condominiums; advise our clients regarding the availability of exemptions from the Interstate Land Sales Full Disclosure Act and state subdivision registration requirements and prepare the documentation required to register with the Department of Housing and Urban Development when required; and make recommendations regarding inclusionary zoning requirements and prepare affordable housing covenants. We have an extensive understanding of-and work regularly with-the guidelines of the Department of Housing and Urban Development, Fannie Mae and Freddie Mac.
