Wrongful Discharge

Sherman & Howard's wrongful discharge attorneys are adept at handling every sort of wrongful discharge claim. Wrongful discharge occurs when an employee's contract of employment has been terminated by his or her employer in a way that breaches one or more terms of the contract or violates a statute provision. The absence of a formal employment contract does not, unfortunately, preclude claims; obligations and rights outlined in an employee handbook can also be considered, and even "at will" employees are entitled to legal protections which preclude them from being fired for reasons that violate the law or public policy. In recent years, cases have frequently involved both tort and contract claims, in addition to statutory complaints. We advise employers in creating personnel policies, procedures, materials and employment practices aimed at avoiding wrongful discharge litigation and at minimizing employer exposure. Should a wrongful discharge claim arise, we also represent employers in federal and state court throughout the nation.
